Charity Law and Governance will build on your understanding of the legal definition of charity (acquired in Equity & Trusts), inviting you to consider the legal and regulatory framework governing charities in greater depth. You will examine closely the role and responsibilities of charity trustees, while gaining valuable insight into aspects such as investment and fundraising or charity campaigning. Weighing up the impact of a slew of scandals that have rocked the charitable sector in recent years, you will also take a closer look at the remit and effectiveness of the Charity Commission, the troubled, independent regulator of charities in England and Wales.

Module learning outcomes

  • Identify and analyse the challenges facing modern-day charity trustees, whether legal, regulatory, or governance-orientated
  • Critically evaluate charity failures by reference to a wide range of relevant primary and secondary sources
  • Explain and critique in depth, developments in charity statute and case law, including decisions of the Charity Commission
  • Design and deliver focused and professional presentations on aspects of charity law, regulation or governance
