Abstract:
This session aims to generate discussion on obstacles to the realisation of migrants’ and minority rights at both the national and European levels. Nick Beard’s contribution will focus on the EU legal framework and the right to asylum on the basis of sexual violence, Stephanie Berry’s on the widening of the State’s margin of appreciation in recent European Court of Human Rights cases on freedom of religion and Tom Southerden’s on obstacles to the use of strategic litigation as a campaigning tool for pro-immigrant policies in the UK.
